Man faces DWI offenses after head-on crash in New York

Being arrested and charged with drunk driving in Rochester can be intimidating and worrisome. This is made worse when there is an accident and other people are injured. While the focus will be on the injured people, it is important to remember that the driver has rights. Part of their rights involves their ability to craft a strong legal defense against the charges.

A car accident sent three people to the hospital and led to the other driver being arrested for drunk driving. The driver was operating a pickup truck and went over the center line and into the oncoming lanes, where he collided with another vehicle. Three people in that car were injured and taken to the hospital. Their injuries are described as serious, but not believed to be life-threatening. The alleged drunk driver injured his arm and received treatment at the hospital. He faces DWI offenses, including vehicular assault, possessing marijuana, and traffic violations. The investigation is ongoing.

There will be an automatic reaction to want to dispense harsh penalties on a person who was allegedly driving under the influence and was involved in a crash that injured others. However, those who are alleged to have been driving under the influence also have rights. There might have been a medical issue that led to them appearing under the influence. It is possible that they were not legally drunk. Having legal assistance is imperative to lodge a defense against DWI charges to avoid the worst possible penalties.
