Rochester, New York – July 18, 2024 – In a rare and decisive victory, Danielle Hampton was acquitted of possession with intent to distribute cocaine and possession of a firearm in furtherance of a drug trafficking crime. These charges carried a mandatory minimum sentence of at least five years. The jury found Hampton guilty only of the much less severe charge of maintaining a residence for the purpose of distributing a controlled substance. Sentencing for this charge is scheduled for October 9, 2024.
Federal acquittals occur in less than 1% of cases, highlighting the significant challenges defendants face when contesting charges in federal court, where the prosecution boasts a very high conviction rate.
“This acquittal is a testament to the hard work and dedication of the defense team, and the willingness of the jury to carefully consider the evidence presented,” said Attorney James Riotto, lead counsel for Hampton. “Our client has always maintained her innocence regarding the more severe charges, and we are grateful that the jury agreed.”
Hampton will return to court on October 9, 2024, for sentencing on the charge of maintaining a residence for the purpose of distributing a controlled substance.
